{"id":3202,"date":"2019-08-22T16:23:00","date_gmt":"2019-08-22T19:23:00","guid":{"rendered":"https:\/\/cbic.org.br\/juridico\/40015-2\/"},"modified":"2019-08-22T16:24:08","modified_gmt":"2019-08-22T19:24:08","slug":"40015-2","status":"publish","type":"post","link":"https:\/\/cbic.org.br\/juridico\/40015-2\/","title":{"rendered":"STJ valida arbitragem posterior ao contrato imobili\u00e1rio"},"content":{"rendered":"<p style=\"text-align: justify\">Embora seja nula a cl\u00e1usula de contrato que determina a solu\u00e7\u00e3o de conflitos por meio de arbitragem quando imposta ao consumidor, \u00e9 poss\u00edvel a instaura\u00e7\u00e3o deste procedimento arbitral em rela\u00e7\u00f5es de consumo, mesmo no caso de contrato de ades\u00e3o, se houver a concord\u00e2ncia posterior das partes com esse mecanismo de solu\u00e7\u00e3o extrajudicial de conflitos.<\/p>\n<p style=\"text-align: justify\">Com esse entendimento, a 3\u00aa turma do STJ negou provimento ao recurso que contestava procedimento arbitral instaurado para dirimir controv\u00e9rsia originada de contrato de promessa de compra e venda de unidade de empreendimento imobili\u00e1rio (contrato de ades\u00e3o) em que os consumidores, em momento posterior, assinaram o termo de arbitragem para a solu\u00e7\u00e3o da controv\u00e9rsia extrajudicial.<\/p>\n<p style=\"text-align: justify\">A relatora do recurso, ministra Nancy Andrighi, anotou no voto que o art. 51 do <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/L8078compilado.htm\">CDC<\/a> se limita a vedar a ado\u00e7\u00e3o pr\u00e9via e compuls\u00f3ria da arbitragem no momento da celebra\u00e7\u00e3o do contrato, mas impele que, havendo o consenso entre as partes, o procedimento arbitral seja instaurado.<\/p>\n<p style=\"text-align: justify\">Conforme o voto da ministra, na hip\u00f3tese, os consumidores celebraram de forma aut\u00f4noma em rela\u00e7\u00e3o ao contrato de aquisi\u00e7\u00e3o de im\u00f3vel um termo de compromisso e participaram ativamente do procedimento arbitral. A decis\u00e3o da turma foi un\u00e2nime.<\/p>\n<p style=\"text-align: justify\">Segundo o vice-presidente Jur\u00eddico da C\u00e2mara Brasileira da Ind\u00fastria da Constru\u00e7\u00e3o (CBIC) e presidente do Conselho Jur\u00eddico (Conjur) da entidade, Jos\u00e9 Carlos Braide Nogueira da Gama, n\u00e3o existe preju\u00edzo na decis\u00e3o. \u201cCaso as partes, de forma livre e consciente, tenham firmado compromisso pela arbitragem para formula\u00e7\u00e3o de uma composi\u00e7\u00e3o, n\u00e3o vejo preju\u00edzo algum. Pelo contr\u00e1rio, quanto mais r\u00e1pida a solu\u00e7\u00e3o de um lit\u00edgio, menos custos a serem dispendidos e maior ser\u00e1 a satisfa\u00e7\u00e3o\u201d, afirma.<\/p>\n<p style=\"text-align: justify\">J\u00e1 a assessora jur\u00eddica da CBIC, Erika Calheiros, explica que a arbitragem \u00e9 uma solu\u00e7\u00e3o alternativa de conflitos, delineada, entre outros fatores, para retirar do poder judici\u00e1rio a sobrecarga de processos que demoram anos para serem resolvidos. \u201c\u00c9 um procedimento mais c\u00e9lere, menos burocr\u00e1tico e especializado, na medida em que o \u00e1rbitro, voluntariamente escolhido pelas partes, geralmente \u00e9 especialista no assunto a ser discutido.
