Uma vez implementadas, as novas normas reduzir\u00e3o o lit\u00edgio e a especula\u00e7\u00e3o no mercado imobili\u00e1rio, beneficiando os consumidores adimplentes e os neg\u00f3cios jur\u00eddicos.<\/span><\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-31128 size-full\" src=\"https:\/\/cbic.org.br\/wp-content\/uploads\/2018\/12\/y1q.jpg\" alt=\"\" \/><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">A <strong>regulamenta\u00e7\u00e3o do distrato<\/strong> e da resolu\u00e7\u00e3o por inadimplemento das partes quando da compra de im\u00f3veis negociados na planta, colocando fim ao v\u00e1cuo jur\u00eddico que vinha impondo inseguran\u00e7a jur\u00eddica e colocando em risco a entrega de empreendimentos do mercado imobili\u00e1rio, foi aprovada na C\u00e2mara dos Deputados e no Senado Federal.<\/span><\/p>\n<blockquote>\n<p style=\"text-align: left\"><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\"><em>\u201cO interesse coletivo deve sempre prevalecer sobre o individual. O conceito de vida em sociedade nos faz cada vez mais pensar no bem de todos, e n\u00e3o no de uma pessoa s\u00f3\u201d<\/em>, afirma Jos\u00e9 Carlos Martins, presidente da C\u00e2mara Brasileira da Ind\u00fastria da Constru\u00e7\u00e3o (CBIC). <em>\u201cO setor imobili\u00e1rio precisava de regras mais claras que punissem os que n\u00e3o cumprem os contratos, sejam eles compradores ou construtores. A legisla\u00e7\u00e3o aprovada pelo Congresso estabelece isso de forma clara\u201d<\/em>, acrescenta.<\/span><\/p>\n<\/blockquote>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">Para Martins, a regulamenta\u00e7\u00e3o do distrato ter\u00e1 efeito positivo sobre o setor, favorecendo a amplia\u00e7\u00e3o do investimento e a consequente gera\u00e7\u00e3o de novos empregos.<\/span><\/p>\n<blockquote>\n<p style=\"text-align: right\"><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\"><em>\u201cFoi fundamental a aprova\u00e7\u00e3o do tema no Congresso Nacional, pois a defesa do setor sobre a irretratabilidade e irrevogabilidade dos contratos acabou desrespeitada pelo Judici\u00e1rio\u201d<\/em>, avalia Celso Petrucci, vice-presidente da \u00e1rea de Ind\u00fastria Imobili\u00e1ria (CII) da CBIC.<\/span><\/p>\n<\/blockquote>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\"><em>\u201cAgora, esperamos que a maior clareza e transpar\u00eancia que se far\u00e3o necess\u00e1rias nos compromissos de compra e venda, seja efetivamente respeitada resultando em maior seguran\u00e7a jur\u00eddica para o funcionamento do mercado imobili\u00e1rio\u201d<\/em>.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">A regulamenta\u00e7\u00e3o do distrato mobilizou a agenda estrat\u00e9gica da CBIC nos \u00faltimos anos \u2013 a entidade fomentou amplo debate sobre o tema, na busca por uma regulamenta\u00e7\u00e3o de consenso.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">Segundo as novas regras, se acontecer a dissolu\u00e7\u00e3o do contrato, a <strong>incorporadora poder\u00e1 reter at\u00e9 25%<\/strong> da quantia paga pelo adquirente.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">Quando o <strong>empreendimento tiver<\/strong> seu patrim\u00f4nio separado da incorporadora \u2013 o chamado regime do <strong>patrim\u00f4nio de afeta\u00e7\u00e3o<\/strong> \u2013, a <strong>reten\u00e7\u00e3o pode ser de at\u00e9 50%<\/strong>.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">Se houver distrato, a empresa ter\u00e1 <strong>prazo de 180 para devolver o valor para o comprador<\/strong>, <strong>descontada a multa<\/strong> correspondente.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">Em situa\u00e7\u00f5es de <strong>patrim\u00f4nio de afeta\u00e7\u00e3o<\/strong>, o per\u00edodo \u00e9 de <strong>30 dias ap\u00f3s a obten\u00e7\u00e3o do habite-se da constru\u00e7\u00e3o<\/strong>.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">As <strong>novas normas<\/strong> tamb\u00e9m <strong>estabelecem direito de arrependimento de 7 dias para os compradores<\/strong>, <strong>multas para incorporadoras<\/strong> em casos de atraso na entrega dos im\u00f3veis, al\u00e9m de medidas importantes de transpar\u00eancia \u2013 como a <strong>obrigatoriedade<\/strong> <strong>de<\/strong> incluir um <strong>quadro resumo nos contratos com as principais condi\u00e7\u00f5es<\/strong>.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\">O presidente do Conselho Jur\u00eddico da CBIC,\u00a0Jos\u00e9 Carlos Gama, enfatiza como a lei beneficia tanto consumidores quanto empreendedores.<\/span><\/p>\n<blockquote>\n<p style=\"text-align: left\"><span style=\"font-family: georgia, palatino, serif;font-size: 12pt;color: #000000\"><em>\u201c\u00c9 importante esclarecer e desmistificar a ideia de que o consumidor inadimplente est\u00e1 sendo prejudicado em prol dos construtores.
